Terms of Service

Please read these terms carefully before using our intelligent concierge services. By using Key AI, you agree to be bound by these provisions.

1. Acceptance of Terms

By accessing or using the Key AI application, dashboard, or API (the "Service"), you agree to comply with and be bound by these Terms of Service. These terms constitute a legally binding agreement between you and Elif Yıldız, a sole proprietorship (şahıs şirketi) established in Türkiye that operates Key AI Chatbot. If you do not agree to these terms, you must not access or use our Service.

We reserve the right to modify these terms at any time. We will provide notice of significant changes by posting the updated terms on our website or through the Service dashboard. Your continued use of the Service after such changes constitutes acceptance of the new terms.

2. Eligibility

To use the Service, you must be at least 18 years of age and possess the legal authority to enter into this agreement. If you are using the Service on behalf of a business entity, you represent and warrant that you have the authority to bind that entity to these terms.

3. Accounts & Security

To access certain features of the Service, you must register for an account. You agree to:

Provide accurate, current, and complete information during the registration process.
Maintain the security of your password and accept all risks of unauthorized access to your account.
Promptly notify us if you discover or otherwise suspect any security breaches related to the Service or your account.

4. Billing & Payments

Key AI Chatbot offers tiered subscription plans (Free, Starter, Growth, Pro) billed through Shopify Billing. By selecting a paid plan you agree to pay the monthly fee shown at checkout. Subscriptions renew automatically until cancelled from the Shopify admin.

All fees are non-refundable except where required by law. Shopify Billing handles all payment processing; we do not receive or store your payment instrument.

Third-party channel fees. WhatsApp conversations are subject to Meta's per-conversation pricing, billed by Meta directly to your WhatsApp Business Account. These fees are independent of your Key AI Chatbot subscription and are not collected by us.

5. Acceptable Use

You agree not to use the Service for any unlawful purposes or to conduct any illegal activity. Prohibited activities include but are not limited to:

Interfering with or disrupting the integrity or performance of the Service.
Attempting to gain unauthorized access to the Service or its related systems.
Using the AI to generate harmful, threatening, or discriminatory content.
Reverse engineering any aspect of the Service.

Helping Shopify merchants serve every customer, on every channel.

6. Intellectual Property

Key AI retains all right, title, and interest in and to the Service, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics. Your use of the Service does not grant you ownership of any content or data you access.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KEYCHAT AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

IN NO EVENT SHALL THE AGGREGATE LIABILITY OF KEYCHAT AI EXCEED THE TOTAL AMOUNT PAID BY YOU TO KEYCHAT AI FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

8. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.
